How much will it cost me to proceed with my claim?
If there is no recovery, then you pay nothing. Dario D. Diaz, P.A. pays all costs during the settlement phase and any litigation. Advance litigation costs can be very expensive, some cases requiring $100,000.00 and higher. Dario D. Diaz, P.A. pays all costs and you pay nothing unless the case settles or you prevail in collecting a judgment after litigation.
What about my car, how do I get it fixed?
Getting your property damage claim settled is different for each insurance company. Some companies send out an adjuster to look at your car, others will let you “drive in” to a location and have an adjuster waiting for you. Dario D. Diaz, P.A. will assist you in making sure that your car is repaired correctly, will work to get you a rental car, and get your property damage claim settled quickly. There is no additional charge for Dario D. Diaz, P.A. working on the property damage claim; all fees are included with the personal injury claim.
Who pays my medical bills and lost wages?
In auto accident cases, your automobile insurance company pays for your medical bills and lost wages. Personal Injury Protection (PIP) insurance generally covers up to $10,000.00 for your medical bills and lost wages. The policies are different and some policies have up to a $2,000.00 deductible. A standard PIP policy will pay 80% of medical bills and 60% of lost wages.
How much is the lawyer going to charge?
In most personal injury cases, Dario D. Diaz, P.A. charges a contingency fee; that is, a percentage of the recovery from the insurance company. Fees vary depending on whether the case settles prior to lawsuit, or if a lawsuit must be filed. In any situation, if you do not get a recovery, we do not collect any fees or costs.
Why would I need to file a lawsuit?
There are cases where the insurance company does not offer adequate compensation to pay for your injuries. The reasons for a low settlement offer vary. If the insurance company makes an offer that is unacceptable to you, the only other remedy is to file a lawsuit and proceed through litigation. However, the choice of filing the lawsuit rests with you.
How long will it take to settle my case?
This question is difficult to answer as there are many variables involved. Some cases are very complex and may take years to resolve. However, most auto accident cases are ready for a demand to the insurance company within six (6) months of the accident. Once the demand is presented to the insurance company, negotiating the claim may take up to ninety (90) days. If the case is not settled and proceeds to litigation, the trial is generally 18 to 24 months after the lawsuit is filed.
